THE FEDERAL BUYER'S GUIDE

 

Under federal law, all dealers must display a "Buyer's Guide" in the window of cars for sale.  This is just a simple one-page form that makes it very clear to the buyer whether a car is sold with a warranty or "AS-IS". There are two boxes that can be checked - an "AS-IS" box and a "warranty" box.

Most smaller dealerships fail to use "Buyer's Guides" because this particular federal law is not strictly enforced and they can get away with it.  In other words, dealers know that federal agents do not drive around all day looking to bust dealers for not sticking a piece of paper in a car window.

Keep in mind, if you are sued, it is possible you may get fined or lose your case if the person suing can prove you did not display one in the window.  For example, if a dealer gets sued for selling a car with a faulty transmission and the isssue is whether the car was sold with a warranty, the buyer will win if he proves the dealer did not display a federally-required "Buyer's Guide".

Where are "Buyer's Guides" obtained?   Generally, states do not supply these. You must purchase them from private companies that make these forms. Most dealer auctions have a booth set up for selling forms.  The forms shouldn't cost more than $10 to $12 per pack.

Note:  Many dealers buy an initial pack of these forms and make copies.  There is no law against making copies of forms - just be sure to "white-out" any logos, business names or phone numbers to avoid copyright infringement.
